These Terms of Service ("Terms") govern your use of the website located at builtsportsperformance.com and any services, programs, or communications offered by Built Sports Performance LLC ("Built Sports Performance," "we," "us," or "our"), located in Las Cruces, New Mexico. By accessing our website, signing up for a program, or opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Our Services

Built Sports Performance provides athletic training, coaching, and adult fitness programs, along with related content, scheduling, and communications. Program availability, pricing, and scheduling are subject to change at our discretion and will be communicated to current members and clients.

2. Eligibility and Accounts

You must be at least 18 years old, or have the consent of a parent or legal guardian, to sign up for our programs or submit your information through our website. You are responsible for providing accurate contact information, including your phone number and email address, and for keeping that information up to date.

3. Assumption of Risk

Physical training involves inherent risk of injury. By participating in any Built Sports Performance program, you acknowledge and voluntarily assume these risks. Participation in in-person training is also subject to a separate liability waiver and informed consent agreement, which you will be asked to review and sign before your first session.

4. Text Messaging Terms

By providing your mobile phone number and opting in through our website, a lead form, at check-in, or during a phone call, you consent to receive recurring automated text messages (SMS/MMS) from Built Sports Performance related to appointment and consult reminders, program and class updates, billing notices, and promotional offers. Message frequency varies. Message and data rates may apply.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

You can opt out at any time by replying STOP to any message you receive from us. After you reply STOP, we will send a one-time confirmation that you have been unsubscribed, and you will not receive further text messages from us. Reply HELP to any message for assistance, or contact us using the details in Section 10 below.

5. Payments and Cancellations

Program fees, billing schedules, and cancellation or refund policies will be provided to you at the time of enrollment. Continued use of our services after a fee change constitutes acceptance of the new fee.

6. Acceptable Use

You agree not to misuse our website or services, including by attempting to gain unauthorized access to our systems, interfering with other users' access, or using our website for any unlawful purpose.

7. Intellectual Property

All content on this website, including text, graphics, logos, and training program materials, is owned by or licensed to Built Sports Performance and may not be copied, reproduced, or distributed without our prior written permission.

8. Disclaimer of Warranties

Our website and services are provided "as is" without warranties of any kind, express or implied. We do not guarantee specific results from participation in our programs.

9. Limitation of Liability

To the fullest extent permitted by law, Built Sports Performance will not be liable for any indirect, incidental, or consequential damages arising from your use of our website or participation in our programs, beyond what is addressed in your signed liability waiver.
